A variance is a provision in the
Perry Land Development Ordinance which allows
an applicant to depart from the standard rules of the
Ordinance. The Perry Planning Commission
has the authority to grant variances in cases where strict application of the Ordinance would result in unnecessary hardship for the property
owner.
That hardship must be a result of physical irregularities or
other extraordinary conditions associated with the property
itself. Such a hardship could include any property whose
shape, size, or exceptional topographic conditions would make
the property nearly impossible to develop. A variance may also
be granted where such conditions would effectively prohibit or
unreasonably restrict the use of the property. Variances may
not be granted for reasons of convenience or greater economic
gain.
Before applying for a variance discuss your situation with a
member of the
Community
Development Department staff. They may be able to
propose a solution that conforms to the Perry Land Development Ordinance
without a variance.
The following information should be submitted to the Community Development Department:

A completed application for a variance to be signed and
dated by the applicant. This application can be downloaded from the
Forms and Publications page.

A copy of the property plat or drawing of the property in question showing
the lot boundaries, structures, abutting streets, site improvements and a
vicinity map.

A $50.00 application fee payable to the City of Perry.
